Educational / Informational / Coaching Services

These Terms of Service (the “Terms”) constitute a public offer by Lana Kudinova Practice LLC (the “Provider”) and govern the purchase and use of services and digital products offered via https://lanakudinova.com (the “Website”).

By purchasing Services and/or otherwise accepting these Terms, you confirm that you have read, understood, and fully accepted them.
 

1. Definitions

1.1. Provider — Lana Kudinova Practice LLC, a U.S.-registered company.

1.2. Website — https://lanakudinova.com (including subdomains) and any other online resources used by Provider to deliver Services (including checkout pages, learning platforms, registration pages, private communities/chats).

1.3. Customer / User — an individual (or authorized representative of an entity) who accepts these Terms.

1.4. Services — paid educational, informational, consultative and/or coaching services and digital products delivered online and/or in-person, including but not limited to:
(a) online courses, programs, intensives, lectures, workshops;
(b) live webinars and recordings;
(c) 1:1 informational/coaching sessions;
(d) group sessions/support groups/group programs;
(e) support/office hours/Q&A/chat support (if included in your plan);
(f) worksheets, guides, templates and other materials;
(g) memberships/subscriptions (if offered);
(h) in-person events/meetups (workshops, meetings, lectures, groups) at the time and location specified by Provider.

1.5. Program / Course — the specific service description (format, duration, access period, scope of materials, feedback/support) shown on the Website and/or checkout page, incorporated into these Terms.

1.6. Webinar — delivery of Services via real-time remote access over the Internet (video/audio/chat and other interactive formats).

1.7. Feedback / Support — informational support related to the Program topic in the form and scope included in your plan (chat, written/audio responses, Q&A sessions, reviews, etc.).

1.8. Platform — third-party tools used to deliver Services (e.g., learning platform, Zoom or similar, payment processors, email services, messengers). Provider may change Platforms without materially reducing the substance of Services.

1.9. Acceptance — full and unconditional acceptance of these Terms by actions such as payment, placing an order, registering, checking a consent box, or other actions clearly indicated on the Website. Terms are standard and not individually negotiated unless Provider expressly agrees in writing.
 

2. Electronic Contract. Age

2.1. The contract is formed at the moment of Acceptance.

2.2. Electronic actions and communications (payments, consent clicks, emails, notifications) have legal force.

2.3. You confirm you are at least 18 years old.
 

3. Important Notice: Nature of Services (U.S.-relevant)

3.1. Provider’s Services are educational / informational / coaching in nature.

3.2. Services are NOT medical care, psychotherapy, psychiatry, diagnosis, treatment, crisis intervention, and do not replace licensed professional or medical services.

3.3. If, at the time Services are provided, Provider and/or the delivering professional does not hold a clinical license in the relevant U.S. jurisdiction, you understand and agree that Provider does not provide licensed clinical services in the United States unless explicitly stated and supported by the required licensure/authorization.

3.4. Emergencies. Provider does not provide emergency services. If you are in danger or at risk of self-harm, call 911 (in the U.S.) or your local emergency number immediately.
 

4. Scope of Agreement

4.1. Provider will deliver the Services described in your selected Program/plan, and you agree to pay the applicable fees.

4.2. Service details are defined by the Website description and/or checkout page and are incorporated into these Terms.
 

5. Service Delivery and Access

5.1. Online delivery. Services are delivered online via Platforms and software. You are responsible for your Internet access and devices.

5.2. Access. Access is provided via email/link/login credentials or via an account on the learning platform. Delivery timing is stated on the Website or in the purchase confirmation.

5.3. In-person events.
5.3.1. Date/time/location and duration are stated on the registration page/ticket/confirmation.
5.3.2. You must follow venue rules and safety requirements.
5.3.3. No-shows may be treated as Services delivered in the form of an opportunity to attend, unless otherwise stated.

5.4. Services are deemed properly delivered when Provider has provided access and/or the ability to attend, regardless of actual usage, unless a specific Program states otherwise.
 

6. Fees, Payment, Subscriptions

6.1. Prices are posted on the Website and may change at any time. Changes do not affect already paid orders.

6.2. Payments are processed through third-party payment processors. Any processor/bank fees (if applicable) are your responsibility.

6.3. Subscriptions (if applicable). Charges recur automatically as shown at checkout until canceled. You must cancel before the next billing date to avoid charges.

6.4. Taxes. You are responsible for any taxes applicable to you as a purchaser, unless otherwise required by law.
 

7. Refunds, Cancellations, Rescheduling

7.1. Digital content/access. Once access to digital content is provided, the Service is considered started. Unless a specific Program states otherwise:

  • before access is provided — refunds may be available;

  • after access is provided — refunds are available only if access was not delivered due to Provider’s fault within a reasonable time, or if your plan explicitly includes a refund option.

7.2. 1:1 sessions (online/in-person). Cancellations/reschedules must be made at least 24 hours in advance (unless your confirmation states otherwise). Late cancellations/no-shows are non-refundable.

7.3. In-person events. Event-specific refund/reschedule rules apply as shown on the registration page. If not specified, tickets are non-refundable; Provider may allow a transfer/reschedule at Provider’s discretion if space is available.

7.4. Refund requests. Email kudinovaso.lana.info@gmail.com with subject “Refund”, including your name, purchase email, Service name, payment date, and brief reasoning.

7.5. Fees. Non-refundable payment processor fees and Provider’s actual costs may be deducted where permitted.

7.6. Chargebacks. If you initiate a chargeback without attempting resolution, Provider may suspend access pending dispute resolution and submit evidence of delivery/access.
 

8. Community / Conduct Rules

Harassment, hate speech, threats, discrimination, spam, unsolicited advertising, sharing third-party personal data, or repeated disruption are prohibited. Provider may moderate content, restrict participation, or remove access for violations, with or without refund depending on severity.
 

9. Intellectual Property

All materials are protected by copyright and owned by Provider (or used lawfully). You receive a limited, non-exclusive, non-transferable license for personal, non-commercial use only. No copying, redistribution, recording, resale, sharing access, or derivative products without Provider’s written consent.
 

10. Privacy

10.1. Personal data is handled under the Privacy Policy: https://lanakudinova.com/terms.

10.2. The Customer agrees to receive service-related communications from the Provider, including notifications regarding access, scheduling, updates, and changes to the Services.
Marketing or promotional communications will be sent only in accordance with the Provider’s Privacy Policy and the Customer’s subscription preferences.

 

11. Disclaimer and Limitation of Liability

No specific outcome is guaranteed. Services are provided “as is” and depend on third-party Platforms and your equipment. To the maximum extent permitted by law, Provider’s total liability is limited to the amount you paid for the relevant Service during the period related to the claim. No liability for indirect damages, lost profits, or decisions you make based on the information provided.
 

12. Force Majeure

12.1. Neither party is liable for delays or failure due to events beyond reasonable control (natural disasters, war, outages, government actions, etc.).

12.2. Illness, scheduling conflicts, travel, or personal circumstances of the Customer do not constitute force majeure.
However, the Provider may, at their sole discretion, allow rescheduling if circumstances reasonably justify it.

 

13. Governing Law and Disputes

These Terms are governed by the laws of the State of New York, USA, without regard to conflict-of-law rules. Parties will attempt informal resolution first via kudinovaso.lana.info@gmail.com. If unresolved, disputes shall be brought in a competent court in New York, unless mandatory law requires otherwise.
 

14. Changes and Final Provisions

Provider may update these Terms at any time by posting on the Website. Continued use after updates constitutes acceptance. If any provision is invalid, the rest remains in effect.
